Terms of Use
Effective date: 25 October 2026
1. About these terms
These terms govern your use of smartlinkautogh.com and the services of SmartLink Auto (“SmartLink”, “we”, “us”). By using the site, creating an account, enquiring, reserving, or buying or selling a vehicle, you agree to these terms. If you do not agree, please do not use the site.
2. What SmartLink does
SmartLink sources used vehicles in South Korea and imports and sells them to buyers in Ghana, and also lets vehicle owners in Ghana list cars for sale to other users. For cars we import and sell, we are the seller. For peer sales between users in Ghana, we provide the marketplace and a supervised “Safe Deal” escrow service to help both sides transact safely; the contract of sale for those vehicles is between the buyer and the listing seller.
3. Your account
You must be at least 18 and provide accurate information. Keep your login details secure; you are responsible for activity under your account. We may suspend or close accounts that breach these terms or that we reasonably believe are being used for fraud or unlawful activity.
4. Vehicle listings and information
Vehicles are used. We describe each vehicle as accurately as we reasonably can, using information and photographs from the source listing and our own inspection, but specifications, mileage, options and condition can contain errors or change, and photos are illustrative. You should check the details that matter to you, and ask us, before committing. Nothing on the site is a guarantee of a vehicle’s condition beyond what we expressly state in writing for a specific vehicle.
5. Prices, quotes and payment
Prices are shown in US dollars and/or Ghana cedis as indicated. A displayed price is an invitation to deal, not a binding offer, until we confirm your order. Unless we clearly state otherwise for a specific vehicle, prices do not include Ghana import duties, clearing, or other government charges, which are the buyer’s responsibility. We accept payment through Paystack (card and mobile money) and by direct MTN Mobile Money transfer to the account we show you; we do not store your card details.
6. Reservations and deposits
You can reserve a vehicle by paying a deposit. A deposit holds the vehicle for you while we confirm availability and arrange the sale. The balance is due as we agree in writing before delivery or collection. Whether a deposit is refundable depends on the circumstances of the cancellation; we will tell you the deposit terms for your reservation before you pay, and you should keep that confirmation.
7. Safe Deal (escrow) for in-Ghana sales
For peer sales within Ghana, our Safe Deal service holds the buyer’s funds until the agreed hand-over is completed. The buyer and seller meet at a supervised location we arrange; meet-up details are shared only once the deal is funded. Funds are released to the seller after the vehicle changes hands and any agreed inspection condition is met. SmartLink facilitates and supervises this process but is not the owner of a peer-listed vehicle and does not warrant its condition; the sale is between the buyer and the seller.
8. If you list a vehicle to sell
You confirm that you own the vehicle (or are authorised to sell it), that your information and documents are true, and that the vehicle is not subject to any undisclosed finance, lien or legal claim. You must provide the ownership and identity documents we request for verification. You are responsible for your listing, and you agree to indemnify SmartLink against claims arising from an inaccurate listing or a sale of a vehicle you were not entitled to sell.
9. Shipping, delivery and clearing
For imported vehicles, shipping and arrival dates are estimates and can change for reasons outside our control. Responsibility for import duties and clearing is as set out in section 5 and as agreed for your vehicle. Risk and ownership pass as described in your invoice or sale agreement.
10. Cancellations and refunds
Because vehicles are used and often imported to order, cancellation and refund rights depend on the stage of your order and the terms given to you when you paid. Where a refund is due, we return it to the method you paid from. This does not affect any rights you have under Ghanaian consumer law.
11. Acceptable use and intellectual property
Do not misuse the site, submit false or unlawful content, attempt to access other users’ data, or scrape or copy the site. The site content, branding and compiled listings are owned by SmartLink or our licensors and may not be reused without permission.
12. Disclaimers and liability
The site is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability in connection with a transaction is limited to the amount you paid us for that transaction. Nothing in these terms limits liability that cannot be limited under Ghanaian law (including for fraud).
13. Governing law and disputes
These terms are governed by the laws of Ghana, and the courts of Ghana have jurisdiction. We would rather resolve any problem directly first, so please contact us before taking other steps.
14. Changes and contact
We may update these terms; the current version is always posted here. Questions? Email smartlinkautogh@gmail.com or call +233 53 111 7295.
